Terms of Use
1. Acceptance of terms
By downloading, installing or using the Cap application (the “App”), published by Neostep (“we”, “us”), you agree to these Terms of Use. If you do not agree, please do not use the App.
2. Description of the service
Cap is a tracking and motivation tool designed to help users reduce or quit a behavior that weighs on them (tobacco, alcohol, screens, etc.). The App lets you track abstinence time, keep a journal, set mini-goals and view statistics.
3. Medical disclaimer
Cap is not a medical device and provides no diagnosis, treatment or medical advice. The App is in no way a substitute for the advice of a health professional. If you feel distressed, experience withdrawal symptoms or have any doubt about your health, consult a doctor or a specialised service. In an emergency, contact emergency services.
4. Account and secret code
Access to the App relies on a secret code generated when the account is created. You are solely responsible for keeping this code safe. We store only an encrypted fingerprint of it: if it is lost, access to your data is permanently impossible and we cannot restore it.
You must be at least 16 years old to use the App, or the minimum age required by the laws of your country.
5. License
We grant you a personal, non-exclusive, non-transferable and revocable license to use the App for strictly personal, non-commercial purposes. You may not copy, modify, decompile, distribute or resell the App, in whole or in part.
6. Acceptable use
You agree not to use the App for unlawful purposes, not to attempt to access other users' data, disrupt the operation of the service or circumvent its security measures.
7. Donations
The App is free. Voluntary donations can be made through our payment provider Stripe to support development and hosting. Donations grant no consideration in return and are non-refundable, except where required by law.
8. Intellectual property
The App, its name, logo, design and content are the property of Neostep and are protected by intellectual property law. The data you enter belongs to you.
9. Limitation of liability
The App is provided “as is”, without warranty of any kind. To the extent permitted by law, Neostep shall not be liable for any direct or indirect damages resulting from the use of, or inability to use, the App, including data loss resulting from the loss of your secret code.
10. Termination
You may stop using the App at any time and delete your account and all your data in one click from the settings. We reserve the right to suspend or terminate access in the event of a breach of these terms.
11. Changes
We may modify these terms at any time. The applicable version is the one published in the App. By continuing to use the App after a change, you accept the updated terms.
12. Governing law and contact
These terms are governed by French law. For any questions, contact us via the App's contact form.
Privacy Policy
1. Our principle: no personal data
Cap is designed to be 100% anonymous. We neither request nor store any data that could identify you: no email, no name, no phone number, no date of birth, no location.
2. Data we process
Account: a cryptographic fingerprint (hash) of your secret code, from which the code itself cannot be recovered, and a random technical identifier.
Usage data: the behaviors you track, your start dates, your events (cravings, relapses), your journal entries (mood, craving intensity, free comments), your mini-goals and your preferences (language, notifications). All of this data is linked solely to the anonymous technical identifier.
Contact form: if you choose to write to us, the email address you provide is used only to reply to you and is not reused for any other purpose.
3. What we do not do
We do not sell, rent or share your data with anyone. We do not display advertising. We do not use advertising trackers or profiling. We do not cross-reference your data with external sources.
4. Legal basis and purpose
Data is processed solely to provide the service: displaying your tracking, journal and statistics, and computing aggregated, anonymous community statistics. The legal basis is the performance of the service you request by using the App.
5. Payments (donations)
Donations are processed by Stripe. No banking data passes through our servers. Stripe processes your payment information according to its own privacy policy. We do not link a donation to a Cap account.
6. Hosting and security
Data is hosted on secure infrastructure. The secret code is never stored in plain text, all exchanges are encrypted (HTTPS) and access to production data is strictly limited.
7. Retention and deletion
Your data is kept for as long as your account exists. You can delete your account and all of your data at any time, in one click, from the App's settings. Deletion is immediate, permanent and requires no explanation.
8. Your rights
In accordance with the GDPR, you have rights of access, rectification, erasure and portability. The App lets you exercise them directly: viewing your data in the interface, exporting your data, and full deletion from the settings. Since your data is anonymous, we cannot link it to your identity outside the App.
9. Children
The App is not intended for children under 16. We do not knowingly collect any data about them.
10. Changes to this policy
If this policy changes, the updated version will be published in the App with its update date. No change will reduce the level of anonymity described here without clear prior notice.
11. Contact
For any privacy-related questions, contact us via the App's contact form.
